Yapıchem Chemical Industry Joint Stock Company (referred to as "YAPICHEM"), we place the utmost importance on ensuring the confidentiality and security of personal data of all our customers and visitors in compliance with the Constitution of the Republic of Turkey, the Law on Protection of Personal Data No. 6698, and relevant legislation. Your personal data is processed by us within the framework outlined below as the "Data Controller" in accordance with the provisions of Law No. 6698 on the Protection of Personal Data and related regulations.

1. Who is Responsible for the Security and Processing of Your Personal Data?

YAPICHEM, we are responsible as the "data controller" for the security of all personal data you provide to us in accordance with the Law on Protection of Personal Data No. 6698.

2. For What Purposes Are Your Personal Data Processed?

Your personal data is primarily processed for the fulfillment of obligations imposed on us by legislation, including the Turkish Commercial Code No. 6102 and the Tax Procedure Law No. 213.
In addition to fulfilling our legal obligations, your personal data is processed to ensure data security, provide the requested product and service at the highest level, provide post-sale support related to the offered products and services, have your profile ready for your next service and product request, and determine suitable services and products for you quickly and accurately. These purposes, which are our most important principle, aim to ensure customer satisfaction.
Furthermore, your personal data may be processed for the improvement of the products and services we offer to you, announcement of our products and campaigns, accurate planning, execution, and management of administrative and communication activities and strategies, enhancement of the services provided on the website, rectification of errors on the website, improvement of service quality, enabling third parties to perform technical, logistical, legal, and similar functions as service providers on our behalf, and ensuring quick and secure processing of your payments when necessary.

3. Who Can Personal Data be Transferred to and for What Purposes?

Necessary individuals for the performance of the service Your personal data may be shared with our business partners, dealers, consultants, legal entities in which our company has an interest, banks, and third parties who carry out technical, logistical, and similar operations on our behalf, in order to ensure the full and seamless provision of the services offered to you, to the extent appropriate to the nature of the service, either domestically and/or in foreign countries declared to have adequate protection by the domestic Data Protection Authority (DPA), or in Turkey in cases where adequate protection does not exist, provided that the relevant foreign data controllers have given a written commitment to adequate protection and the DPA's permission is obtained. These third parties are limited to individuals who necessarily need access to the relevant information for the full and seamless provision of the respective services.
Persons required by law to share the data Your personal data may be transferred, limited to the relevant individual or institution, when it is necessary for YAPICHEM to fulfill its legal obligations, when it is explicitly stipulated by laws, or when there is a valid judicial/administrative order issued in accordance with the law.
Consultants and service providers Your personal data may be transferred to third parties with whom we cooperate and/or receive services from, including domestic business partners and/or foreign data controllers in countries declared to have adequate protection by the DPA, or in Turkey in cases where adequate protection does not exist, such as banks, financial institutions, law firms providing support in legal, tax, and similar matters, consultancy firms, and other relevant parties with whom the transfer is necessary for the designated purposes, as well as authorized institutions and organizations. Additionally, if necessary, data may be transferred to cloud environments located abroad, taking the necessary security measures.

4. How and on What Legal Grounds are Your Personal Data Collected?

 Your personal data is collected through our sales points, branches, dealers, or forms filled out on our website, information provided to us via mail, email, fax, and similar channels, voice calls with us, or in-person meetings at our company. The collected personal data is collected in accordance with the purposes stated above, for the complete and accurate fulfillment of our contractual and legal obligations, as required by the obligations imposed on us by legislation, including the Turkish Commercial Code numbered 6102, the Tax Procedure Law numbered 213, the Law on the Protection of the Consumer numbered 6502, the Law on the Protection of Personal Data numbered 6698.
Within this scope, the legal grounds relied upon for the collection of your personal data, depending on the nature of the data, are as follows: explicit consent, explicit provision in laws, necessity of processing for the performance of a contract, necessity of processing for compliance with a legal obligation, necessity of processing for the legitimate interests pursued by the data controller.

Processed Personal Data - Legal Grounds for Processing

Name, Surname, Turkish Identification Number, Address: Processed due to the legal obligation imposed by Article 230 and subsequent articles of the Tax Procedure Law No. 213 and Article 82 of the Turkish Commercial Code No. 6102 when goods or services are received from us. (Article 5/2-a of Law No. 6698)

Email, telephone, and other contact information: Processed due to the necessity of processing personal data of the parties to the contract for the performance of contractual relations, establishment of communication between the parties, and necessary notifications regarding the goods and services provided when you receive goods or services from us. (Article 5/2-c of Law No. 6698)

Service history: Recorded for the purpose of improving service quality by identifying suitable products for you, conducting product planning, and informing you about suitable products and services if requested. These records are processed based on the necessity of processing personal data for the legitimate interests pursued by the data controller, provided that they do not harm the fundamental rights and freedoms of the data subject. (Article 5/2-f of Law No. 6698)

5. How Long are Your Personal Data Retained?

Unless longer periods are prescribed by legislation, your personal data is retained for a maximum of 10 (ten) years in accordance with Article 182 of the Turkish Commercial Code and Article 146 of the Turkish Civil Code.

6. What Are Your Rights Regarding Your Personal Data?

In accordance with the Personal Data Protection Law No. 6698, you have the right to apply to the data controller regarding your personal data and:

a. Learn whether your personal data is being processed,
b. Request information if your personal data has been processed,
c. Learn the purpose of the processing of personal data and whether they are used in accordance with their purpose,
d. Be informed about the third parties to whom your personal data is transferred domestically or internationally,
e. Request the correction of your personal data if it is incomplete or inaccurate,
f. Request the deletion or destruction of your personal data if the reasons requiring the processing of personal data no longer exist,
g. Request that the actions taken pursuant to items (d) and (e) be notified to the third parties to whom your personal data has been transferred,
h. Object to the occurrence of a result against yourself by exclusively analyzing the processed data through automated systems,
i. Demand compensation for damages in case you incur damages due to the unlawful processing of personal data.

Aromatik Cad. No:27 Tuzla/İstanbul" by hand with wet signature or through a notary, or you can send it electronically with a secure electronic signature to yapichem@hs01.kep.tr email address.

In your request, clearly specify the right/claim you want to exercise along with your identification information, and provide all relevant information and documents related to your request.

The requests conveyed to us that possess the necessary qualifications will be concluded within 30 (thirty) days depending on the nature of the request, and the result will be notified to you in writing or electronically, in accordance with the feedback method you have chosen in your request.
